Civil Procedure S.55, 59, 60 & 63 - mandatory - failure to issue summons - its effect - duty of the trial court

In this case, the 1st Plaintiff had tendered summons to be issued to the Petitioner, the said motion had never been minuted and hence there is no order to issue summons.
held - it is the duty cast upon the trial court to satisfy that the provisions of Sections 55, 59, 60 and 63 has been duly complied with and then to proceed with the case accordingly.
