I think every Civil Law practitioner should keep a hard copy of this Judgment where Justice Prasanna Jayawardena, PC analyzed the law relating to the addition of parties under the Civil Procedure Code. However, as Honorable Justice Jayawardena stated somewhere in his judgment this is not the complete guide on the subject.

In Barbara Iranganie De Silva and others v. Hewa Waduge Indralatha , the Defendant Respondent made an application under Section 86(2) of the Civil Procedure Code seeking to purge the default. The Plaintiff Appellant objected and the matter was fixed for inquiry. At the end of the inquiry, the District Court delivered Order on 09.05.2014. dismissing the Application to purge the default made by the Defendant Respondent.  The Defendant Respondent thereafter filed a “ notice of appeal “ against the said Order of the District Court dated 09.05.2014. She filed a Petition of Appeal (Final Appeal ) seeking to challenge the said Order. 1995 අංක 14 දරන සාක්ෂි (විශේෂ විධිවිධාන) පනත තවමත් නීතියේ දී වැදගත් වන පනතකි. විශේෂයෙන් ම අපරාධ අධිකරණයන්හි නඩු කටයුතුවල යෙදෙන අයවලුන්ට වීඩියෝ/ඔ්ඩියෝ සාක්ෂි මෙහෙයවීමේ දී මේ පනත වැදගත් වේ. මේ පනතේ 7 වන වගන්තිය නඩු තීන්දු කීපයකදී ම අර්ථ නිරූපනයට ලක්ව ඇත. එහි දැක්වෙන්නේ පනත යටතේ සාක්ෂියක් මෙහෙය වීමට බලාපොරොත්තු වන පාර්ශ්වයක් විසින් අනුගමනය කළ යුතු කාර්ය පටිපාටියේ කොටසකි. ඒ අනුව 7(1)(අ) වන වගන්තියෙන් දක්වන්නේ එවැනි සාක්ෂියක් ඉදිරිපත් කිරීමට බලාපොරොත්තු වන පාර්ශ්වය විසින් පරීක්ෂණය හෝ නඩු විභාගය පැවැත්වීමට නියමිත දිනයට දින 45 කට පෙර අදාළ පියවර ගත යුතු බවයි. මේ 7(1)(අ) වගන්තියේ දැක්වෙන ‘පරීක්ෂණය හෝ නඩු විභාගය පැවැත්වීමට නියම කර ඇති දිනට දින හතළිස් පහකට පෙර’ යන පාඨය අර්ථ දැක්වීමේ දී අභියාචනා අධිකරණයේ නඩු තීන්දු මත දෙකක සිටින බව පෙනේ. එයින් එක් මතයක් වන්නේ මේ කියන්නා වූ දිනය, නඩුවේ පළමු විභාග දිනයට පෙර දින 45 ක් විය යුතු බවයි. ඒ සම්බන්ධයෙන් වන විට CA /COC /0005/2017 decided on 23.11.2021 නියෝගය වැදගත් වේ. අනෙක් මතය වන්නේ මේ කියන්නා වූ දිනය පළමු විභාග දිනය නොව ඔ්නෑම විභාග දිනයකට පෙර විය...
